Home Buyers

An asbestos investigation is recommended in your standard escrow instructions. It is recommend that this investigation should be performed by a Certified Asbestos Consultant (CAC).

Contractors

Current law requires that any material being disturbed during a renovation or demolition must be tested for asbestos prior to renovation and/ or demolition.

Homeowners

No one is more qualified or knowledgeable than a Certified Asbestos Consultant (CAC)/ Certified Site Surveillance Technician (CSST) for identifying asbestos containing building materials in your home .

Employers

California law requires that warnings be given where hazardous materials may present a significant risk as defined by Proposition 65. This requires the employers to utilize asbestos management plans & 2-hr asbestos awareness training to help identify & understand asbestos building material hazards.

Senate Approves Mold Claim Bill

The senate approved SB. 1763 by a 21-11 vote, that insurers would be forced to cover mold claims, a move that trade groups said could cause an availability crisis for homeowners insurance in the state. The bill would prohibit both commercial and personal insurers from seeking exclusions on mold coverage as an ensuing loss—a loss that followed a covered peril, such as a fire or a broken water pipe.

FACT

California State Law in the Business and Professions Code Section 7180-7189.7 states, “It is illegal in the state of California for any person to engage in the practice of an Asbestos Consultant … unless he or she is certified by the Division of Occupational Safety and Health.” “When the building owner or operator engages the services of an Asbestos Consultant… the building owner or operator shall contract with a person who is certified by the Division of Occupational Safety and Health.” “When an owner or operator contracts with an Asbestos Consultant… that Consultant shall not have any financial or proprietary interest in an Asbestos Abatement Contractor hired for the same project.” Furthermore, Section (7180-7189.7), an Asbestos Consultant is defined as, “any person who contracts to provide professional health and safety services relating to asbestos-containing-material as defined in… including building inspections, abatement project design, contract administration, supervision of site surveillance technicians… sample collections, preparation of asbestos management plans, and clearance air monitoring.” Asbestos removers as stated by the USEPA (United States Environmental Protection Agency) are to provide the materials, equipment, and labor necessary to complete asbestos abatement work.
